Individual legislators can voluntarily refuse their pensions, but no, they cannot legally eliminate legislative pensions for current legislators who are members of the pension system. While it is true there is no union to stand in the way, the courts have made it crystal clear that the state constitution does not allow diminishment of pensions for current employees. Indeed, GARS was part of the pension reform legislation passed in December 2013 that was struck down 7-0 by the Illinois Supreme Court.

Ted & John: Wow, what a terrific description of the mess. And it appears stunning that the part-time jobs they took, have led to mammoth-size pensions any full-timer would envy. Stunning that they’ve feathered their nest so carefully and richly, that it will take quite a bit of effort to overcome their self-interest and not do everything in their power to screw taxpayers to save their pensions. Sad.
