Jumbo and Pinhead are saying that they won and that the Courts decision concludes that there is no emergency in Chicago. But really it appears that the courts are saying: “the Government has failed to identify a source of authority that would allow the military to execute the laws in Illinois.” It’s not as sexy, but this sounds more procedural in nature…like the Court can’t identify rules by which the the Guard would operate and who would have the control to determine orders in a Illinois civilian environment.
