Illinois Director of the National Federation of Independent Business Mark Grant said lawmakers are leaving employers on the hook for the debt. "Lawmakers are divvying up tens of billions of dollars in state and federal revenue while small businesses, the engine driving Illinois’ economic comeback, are about to be stuck with a $5 billion tax bill in the form of huge hikes in unemployment taxes brought on by the pandemic shutdowns."
Why shouldn’t there be a qui tam lawsuit?
Similarly to a successful qui tam suit brought against well-intentioned beer and wine producers (who even followed legal guidance as to collecting sales tax issued by the State), the defendants here have apparently”defrauded the State”. The State doesn’t have the power to prevent litigation seeking collections of “fraudulently obtained funds” on the State’s behalf.
Looks like the State has all the evidence nicely collated …
This would make some sense if some of these fraudsters were collectible. You’d also need an honest and brave judge. Where is the law firm with cajones for the cause?
A largely unasked question is becoming glaring: Is Illinois doing all it should to use artificial intelligence to make government cost less and work better? So far, the evidence says no.
