It is a city on the verge of collapse. Schools are shut for no good reason and the unions ignore the mayor. She and her crew are totally inept. The Gov is clueless. Who says a Union cannot be broken?
It CAN although it’ll be costly in attorney fees because the union will fight it until they run out of money to pay lawyers. Illinois courts will be unfavorable and may threaten injunctions, fines and jail time. Not sure if it can be moved into the federal court system. There is a federal as well as a state constitutional contract clause, but federal courts sometimes do not take constitutional questions that can also be adjudicated in state courts. Does this wildcat strike violate their most recent labor contract? Is this new proposal “good faith bargaining” and how is bargaining applicable if they are engaged in a work stoppage that presumably violates the labor contract? Can the district void the labor contract and all the raises and other improvements granted in that contract? Can the district demand arbitration or would that be futile because arbitrators are in the union’s pocket? Unless there is some strategy to force the union’s hand, do the lockout.
