Illinois Bans Most Employers from Using E-Verify – Federation for American Immigration Reform

Section 13(b) of the Act reads that an “employer shall not impose work authorization verification or re-verification requirements greater than those required by federal law.” As federal law does not require the use of E-Verify, Illinois employers may not use E-Verify to check whether their employees are work authorized unless there is some reason (such as prior violations) that the federal government requires them to.

The myth of the good natured illegal immigrant is just that: a myth. The illegal immigrant regularly breaks the law because they think nothing will happen to them and they have near zero understanding of the second order effects of their actions. They use fake IDs, fraudulent IDs, the take the IDs of others. They take out credit cards and debt under one social security number and then pay taxes under a second, like a TIN. The real issue is State of Illinois corporate by-laws can’t compel employers to aid and abet illegal activity. This is infuriating, tbh. I’ve never understood why there is no federal law forcing employers to use E-Verify. It’s an excellent and easy to use system.

I heard there’s union contracts that do not allow employers to do background checks on employees. Case in point at the United Center they were going to do a background check on every employee for the DNC. Food service union employees were not required to submit to it. They were excused from working the convention with no penalty.

There are any number of federal government contracts which require e-verify. Under those contracts, failure to comply is not merely a breach of contract but could result in an impli9ed certification false claim action (off contract). One more reason to stay clear of Illinois if you are a business.
