Judge Rules Elimination of Cash Bail in SAFE-T Act Unconstitutional – NBC5 (Chicago)

Specifically, Circuit Judge Thomas Cunnington's ruling held that the SAFE-T Act violated the Separation of Powers Clause, the Victim Rights Act, and unconstitutionally amended Article I, Section 9 of the state's constitution, which codified cash bail in the state. The law will not go into effect on Jan. 1 in the 65 counties that signed onto a lawsuit filed against the administration of Illinois Gov. J.B. Pritzker.

This does not apply to the Counties that were not part of the lawsuit – hence – Cook County and Dupage County will end cash bail on January 1st. This is a small victory for those counties that sued but most of the collar counties that did not join the lawsuit, where the majority of crime happens are not part of this.

But I think this means if the Supreme Court rules that it is indeed unconstitutional, then the counties not participating in the lawsuit will have to go back and re-address any sentencing between Jan 1 and that ruling. This could get messy, which leads me to believe the fix will be in at ILSC.

They’ve got a little over 48 hours left to issue a ruling. if they overturn a well-reasoned opinion, and the constitution itself, for political reasons on a 5-2 basis, god help us all.
